A FTSE SMALL CAP Company Secretary writes...
“Argus Vickers have submitted a S116 request to review the Register of members every month for an indefinite period. I understand from our registrars that this request has been made in respect of hundreds of listed companies. The purpose seems to be ‘proper’ of ‘producing statistical research data products’ in which ‘no individuals or personal information would be subsequently disclosed’.
Have you received this request and how do you plan to respond? We are minded to accede but for a limited time period, perhaps 12 months.”

We have received this request also, even though we are already dealing each month with Argus Vickers’ 811 requests. We are trying to find out what is behind it and whether the registrars take a view, given that they will have to deal with the extra workload On the face of it, looking at s117, there does not seem to be much option but to comply!

We receive such requests which are periodically forwarded by our Registrars, Equiniti. Assuming Equiniti are happy that the request is genuine (and assuming it looks genuine to me) I let Equiniti deal with them. As I understand it, they are charged by the Registrar for obtaining the information (so no cost to the Company or the Registrar) and the request cannot be refused unless it is not for a ‘proper purpose’.

I allow them access but do not grant it for a long period of time and certainly not for 12 months

We have received such a request. It appeared “proper” so we have acceded to it (not limited it by time. If Argus Vickers want to send one of their “data inputters” to the registrars each month to record information that they are entitled to record, and to use it for proper purposes, then so be it.
